The materials contained on our site are provided for general information purposes only and do not claim to be or constitute legal or other professional advice and shall not be relied upon as such. We do not accept any responsibility for any loss which may arise from accessing or reliance on the information on this site and to the fullest extent permitted by English law, we exclude all liability for loss or damages direct or indirect arising from use of this site. We process information about you in accordance with our privacy policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate. By volunteering to contact GlassHouse through the online forms, you automatically consent to adhering to all terms and conditions detailed here.

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable if for any reason our site is unavailable at any time or for any period.

All samples, drawings, descriptions, specifications, illustrations, photographs and advertising or equivalent or otherwise (“Sample(s)”) are issued or published on the Site for the sole purpose of giving an approximate idea of the products represented by or described in them. By using this Site, you appreciate that the colour of the product as they appear in the Samples may not accurately reflect the colour when the product is actually viewed and colour variation may otherwise occur outside of our control or the manufacturer, and whilst we use reasonable endeavours to ensure that the Site Samples match the actual product, we cannot and do not guarantee this. Accordingly, any purchase by you of any product based on the Site Samples alone will not be deemed as a sale by sample.

If you have an account with us, then you are responsible for maintaining the confidentiality of this account and any related passwords for your restricting access to your computer and/or account. You agree to accept responsibility for all activities that take place under your account and/or passwords. Currently, only employees, CO dealers and their employees and certain vendors require passwords to access certain portions of the web site. At this time, general consumers do not require passwords to access our Site. In the event that providing you with a password becomes necessary or helpful to your use of our Site, you will be responsible for maintaining the confidentiality of this account and any related passwords for your restricting access to your computer and/or account. You agree to accept responsibility for all activities that take place under your account and/or passwords.

 

Other than personal data or sensitive personal data about you, which is covered under the terms of our Privacy Policy, any material you transmit or post to the Site shall be considered non confidential and non-proprietary. We shall have no obligations with respect to such material. We and designated third parties shall be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes.  We shall fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity or locate anyone posting any material in breach of the above prohibitions.

You agree that we may in our sole discretion and at any time terminate any password and account (or any part thereof) of yours without limitation, if we reasonably believe that you have violated or acted inconsistently with the letter or spirit of these terms.

 

General Terms: By signing up for a Services account you agree to pay GlassHouse the applicable setup fees and recurring fees. Applicable fees will be invoiced starting from the day your services are established and in advance of using such services (additional payment terms may be included in other communications). GlassHouse reserves the right to change the payment terms and fees upon thirty (30) days prior written notice to you. Payments are not refundable. 

 

Automatic Renewal: Unless you notify GlassHouse before the end of the applicable subscription period that you want to cancel a subscription, your subscription will automatically renew and you authorise us to collect the then-applicable annual or monthly subscription fee for such subscription (as well as any taxes) using any credit card or other payment mechanism we have on record for you. Upgrades can be canceled at any time by submitting your request to Glasshouse in writing.

 

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

This Agreement does not transfer from Glasshouse to you any GlassHouse or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with GlassHouse. As GlassHouse asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by glasshousedesignandglazing.co.uk violates your copyright, you are encouraged to notify GlassHouse. GlassHouse will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. You represent and warrant that (i) your use of the Website will be in strict accordance with the GlassHouse's Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United Kingdom or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.

You agree to indemnify and hold us, our officers, employees, agents, consultants, licensees, web designer, web personnel and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including, without limitation, reasonable legal and accounting fees, resulting from or alleged to result from, your use of the Content of the Site in a manner that violates, or is alleged to violate, these terms. We shall provide notice to you promptly of any such claim, suit, or proceeding, and shall reasonably co-operate with you, at your expense, in your defence of any such claim.

These terms are governed by, and construed in accordance with, English Law unless you live in Scotland in which case, these terms will be governed by Scots Law and you and us irrevocably agree that the UK Courts shall have non-exclusive jurisdiction to settle any dispute which may arise out of or in connection with these terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the non-exclusive jurisdiction of the UK Courts.

GlassHouse reserve the right to end or change offers featured on our website at any time without prior notice. All others and products are subject to availability. All finance is subject to status and written quotations are available upon request. 

 

GlassHouse may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your glasshousedesignandglazing.co.uk account (if you have one), you may simply discontinue using the Website. Notwithstanding the foregoing, if you have a paid services account, such account can only be terminated by GlassHouse if you materially breach this Agreement and fail to cure such breach within thirty (30) days from GlassHouse's notice to you thereof; provided that, GlassHouse can terminate the Website immediately as part of a general shut down of our service. All provisions of this Agreement which, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

GlassHouse reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. GlassHouse may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.
